HRCI applies great value to the privacy and protection of the PII of all HRCI stakeholders within HRCI’s control and is committed to compliance with this Privacy Policy and in accordance with applicable data protection laws where HRCI operates. This Privacy Policy also describes your rights and responsibilities in addition to our rights and responsibilities. The rights and responsibilities described in our Privacy Policy do not cover third party websites that may be referred to or linked to our Website or the Services. These third party websites have their own privacy policies and you are encouraged to review them.

The following defined terms are used throughout this Privacy Policy, and other capitalized terms are defined either by applicable law or within this Privacy Policy, as the context conveys.

“Applicable Law” means the relevant personal data protection law or regulation relating to the protection of personal data as applicable to HRCI’s business in the jurisdictions where HRCI operates either on behalf of itself or through a trusted service provider.  Applicable Law includes, but is not limited to,

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”);
  • The consumer data protection and/or privacy acts of the United States of America and the respective states of the United States of America as they become effective and are applicable; and
  • Other relevant data protection regulations and laws in the states, countries and territories where HRCI operates.

In some cases, we may handle so-called ‘special categories of PII’ about you, which may be considered sensitive, such as: race or ethnic origin, biometric templates as collected by our trusted service providers and where permitted by law; or medical or health information when requesting a test accommodation. Before we collect ‘special categories of PII’ we will mark the question(s) as ‘optional’ or require your consent. Such consent may be withdrawn at any time.

“Process” “Processing” and “Processed” means any operation or set of operations which is performed on PII or on sets of PII, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, making available, aligning, combining, erasing or destroying PII.

HRCI reserves the right to revise this Privacy Policy at any time to address changes to our PII Processing practices or changes in Applicable Law. If HRCI makes changes to this Privacy Policy, HRCI will post those changes on the Website. Where revisions result in material changes to the purpose for original collection of PII or the scope of PII Processed, HRCI or our trusted Service Providers on our behalf will provide notice of such material changes to you and seek your consent to such changes where required by Applicable Law.

BY USING THE WEBSITE OR THE SERVICES, YOU ARE SIGNIFYING YOUR UNQUALIFIED AGREEMENT TO AND ACCEPTANCE OF HRCI’S PERSONAL DATA COLLECTION AND PROCESSING PRACTICES AS OUTLINED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THE TERMS OF THIS PRIVACY POLICY, DO NOT USE THE WEBSITE OR THE SERVICES. How Does HRCI Store, Protect, and Retain PII?

HRCI stores all PII collected by HRCI in our secure cloud infrastructure in various regions in the United States with commercially reasonable technical and organizational data protection safeguards in place.

As is appropriate for the nature of PII collected and stored by HRCI, the Services are protected by industry standard security measures or safeguards to minimize the risk of loss, misuse and alteration of the PII under HRCI’s control. With respect to any stored PII, HRCI will also use commercially reasonable efforts to preserve such PII in its original form to the extent possible and as consistent with any Processing that is directed by you or necessary for HRCI to provide the Services. Access to PII is restricted to authorized personnel and Service Provider personnel who have a need to access the PII to perform their duties for HRCI and are subject to strict confidentiality and data protection obligations, and HRCI employs encryption, access controls, and other measures to protect data in transit and at rest. Regular backups and disaster recovery plans ensure the availability and integrity of stored PII. In the event of a breach of PII, HRCI would follow its incident response plan and take appropriate actions to stop, mitigate and remediate the breach and any risks to HRCI stakeholders.

HRCI may store PII for a period no longer than necessary for the purpose of operating its business and providing the Services to you except as otherwise outlined herein. HRCI follows a comprehensive records management and retention schedule for the purposes of retention, storage and destruction of all records created in the course of HRCI’s business including those containing PII. California Residents: Companies that collect PII from California residents and disclose such information to third parties (including affiliated entities) for direct marketing purposes must, in response to a request by a consumer, either (1) provide a list detailing the categories of information shared and the entities to which such information was provided, or (2) provide a mechanism by which a consumer may opt-out of having their PII shared with third parties.

HRCI has elected the second option, and you may request that your PII not be shared with third parties by sending your request, including your full name, email address and postal address, to HRCI, Attn. Privacy, 1725 Duke Street, Suite 400, Alexandria, VA 22314.

Where PII is Processed within the European Union (“EU”), the United Kingdom or Switzerland and must be transferred to sub processors or other third-parties in a country not considered to provide an adequate level of protection according to Applicable Law, HRCI ensures that it has the appropriate standard contractual clauses in place with such sub processors as approved by the EU Commission, the ICO and the FDPIC, adopts appropriate technical and organizational security measures that govern the transfer of PII to ensure an adequate level of protection, and prior to any transfer evaluates the circumstances of the transfer and the legislation of the importing country and completes a data transfer impact assessment where required by Applicable Law.

Any information you provide will be transferred to the United States. In some jurisdictions your explicit consent is required to transfer your PII outside of the country in which you are located.  Where applicable, you will be asked to consent to the transfer and processing of your PII to the United States through your acknowledgement and agreement to the terms of the HRCI Certification Terms of Service and the Candidate Agreement.
